OVERVIEW

Welcome to MODHIDES. The terms “we”, “us” and “our” refer to Modhides Company Ltd, a company registered in England and Wales.

MODHIDES operates this website and online store, including all related information, content, tools, products and services (collectively, the “Services”). MODHIDES is powered by Shopify.

By visiting our website, using our Services or purchasing products from us, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with these Terms, please do not use our Services.

Nothing in these Terms affects your statutory rights under applicable UK consumer law.

SECTION 1 – ACCESS AND ACCOUNT

You agree to provide accurate, complete and current billing, shipping and contact information when placing an order or creating an account.

If you create an account, you are responsible for keeping your account information and login details secure and for activities carried out through your account.

SECTION 2 – OUR PRODUCTS

We make reasonable efforts to display our products, colours, finishes and photographs as accurately as possible.

As genuine leather is a natural material, each piece has its own natural grain, texture and character. Slight variations in colour, texture and finish may therefore occur between individual products and product images.

Product descriptions, specifications and availability may change from time to time.

We reserve the right to limit quantities or discontinue products where necessary.

Nothing in this section limits your statutory rights regarding the quality, description or suitability of our products.

SECTION 3 – ORDERS

When you place an order through our website, you are making an offer to purchase the selected products.

We will send an acknowledgement confirming that we have received your order. A contract is formed when we accept your order and confirm that it has been accepted for processing.

We reserve the right to refuse or cancel an order in limited circumstances, including where a product is unavailable, there is an obvious pricing or description error, or we reasonably suspect fraudulent or unlawful activity.

If we cancel an order after payment has been taken, we will provide a full refund of the amount paid for the cancelled order.

Standard retail orders are intended for personal use and are not for resale.

Separate arrangements and terms may apply to corporate, custom and bulk orders.

SECTION 4 – PRICES AND BILLING

All prices are displayed in GBP (£) and include VAT where applicable.

Delivery charges for standard retail/B2C orders are set out in our Shipping & Delivery Policy and, where applicable, displayed at checkout.

Shipping for custom, corporate and bulk orders is calculated separately and will be discussed and agreed before the order is confirmed.

You agree to provide current and accurate payment and billing information and authorise us to charge your selected payment method for the total amount due.

We reserve the right to correct pricing errors before accepting an order.

SECTION 5 – SHIPPING & DELIVERY

Delivery arrangements and estimated delivery times for standard retail/B2C orders are set out in our Shipping & Delivery Policy.

Delivery times are estimates and may be affected by circumstances outside our reasonable control.

Risk in the goods passes to you when you, or a person nominated by you, take physical possession of the goods.

If you arrange a courier independently of the delivery service offered by us, risk passes when the goods are handed to that carrier.

Ownership of the goods remains with MODHIDES until full payment has been received.

Nothing in this section limits your statutory rights relating to delivery or risk.

All content on this website, including text, images, photographs, logos, graphics, designs, layouts and other materials, is owned by or licensed to MODHIDES and is protected by applicable intellectual property laws.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

MODHIDES uses Shopify to operate and provide the technology supporting our online store.

Your purchase contract is with Modhides Company Ltd, not Shopify.

Shopify provides the ecommerce platform and related technology but is not responsible for the products we sell, their quality, fulfilment or our obligations to you.

SECTION 10 – PRIVACY POLICY

Personal information collected through our website is handled in accordance with our Privacy Policy.

SECTION 11 – FEEDBACK

You may not transfer your rights or obligations under these Terms to another person without our written permission, except where permitted by law.
